By booking a session with ShotbyDvD, the Client agrees to the following terms and conditions:
1. BOOKING & PAYMENT
Portraits & Weddings: A non-refundable retainer of 50% of the total package price is required to secure the date and time. The remaining balance is due on or before the day of the photoshoot.
Real Estate & Business Marketing: Payment is due in full upon delivery of the final images. Invoices not paid within 30 days will incur a late fee.
Late Fees: Invoices not paid within the agreed timeframe may be subject to a late fee of 5% per month until paid in full.
2. CANCELLATION & RESCHEDULING POLICY
Notice Requirement: A minimum of 24 hours’ notice is required for any cancellation or rescheduling.
Late Cancellations:
Portraits & Weddings: Cancellations made with less than 24 hours’ notice will result in forfeiture of the 50% retainer.
Real Estate & Business: Cancellations made with less than 12 hours’ notice may incur a $50 cancellation fee to cover lost time.
Weddings: Due to the exclusive nature of wedding bookings, the 50% retainer is non-refundable under any circumstances.
Weather: For outdoor sessions and real estate exteriors, if weather conditions are unsafe or unfavorable, the session will be rescheduled at no additional charge.
3. SITE READINESS & CLIENT CONDUCT
Punctuality: Clients are expected to arrive on time. Time lost due to late arrival will be deducted from the session duration.
Safety & Conduct: ShotbyDvD reserves the right to terminate a session immediately if conditions are unsafe or inappropriate. No refunds will be issued.
Real Estate Preparation: Properties must be camera-ready upon arrival. ShotbyDvD is not responsible for cleaning, decluttering, or moving heavy furniture.
4. COPYRIGHT & USAGE RIGHTS
Portraits & Weddings (Personal Use License): Clients receive a print release for personal use only. Images may not be sold or used commercially without written permission.
Real Estate (Listing License): Images are licensed solely for marketing the specific property listing and may not be transferred or reused without an additional license.
Business Marketing (Commercial License): Clients receive a license for digital and print marketing use.
ShotbyDvD retains full copyright ownership of all images.
5. CREATIVE DISCRETION
The Client acknowledges familiarity with ShotbyDvD’s portfolio and artistic style. Editing decisions are left to the photographer’s discretion.
ShotbyDvD does not deliver unedited or RAW image files under any circumstances.
6. DELIVERY TIMELINE
Estimated delivery times:
Real Estate: 24–48 hours
Portraits & Business: Up to 7 days
Weddings: 4–6 weeks
7. LIMITATION OF LIABILITY
ShotbyDvD’s liability is limited to the amount paid by the client.
8. MODEL RELEASE
The Client grants ShotbyDvD permission to use images for portfolio, website, social media, and marketing purposes unless a written opt-out is provided prior to the session.
